LiveStats Terms and Conditions of Use

These Terms and Conditions of Use ("Terms of Use") apply to the LiveStats real-time website traffic tracking and analysis service ("LiveStats") provided by Go Squared Ltd. ("GoSquared") and any subsection of the websites located at www.gosquared.com or any other website (the "Site") maintained by GoSquared connected to the LiveStats service. BY USING THE LIVESTATS SERVICE YOU AGREE TO THESE TERMS OF USE. IF YOU DO NOT AGREE TO THESE TERMS OF USE, DO NOT USE THE LIVESTATS SERVICE.

GoSquared reserves the right, at its discretion, to change, modify, amend, add or remove any part of these Terms of Use at any time. It is your sole responsibility to refer periodically to these Terms of Use to check for changes. Continuing to use the LiveStats service following any changes to these Terms of Use signifies agreement to any amendments made to these Terms of Use.

Member Sites

A "Member Site" is defined to be any website signed up to use the LiveStats system. Member sites have an obligation to inform their visitors via their privacy policy or other relevant legal document of the details of the LiveStats tracking system. Member Sites also agree to take full responsibility for the legality of the tracking of their visitors' details. GoSquared accepts no responsibility for any privacy infringement as a result of tracking viewing statistics via the LiveStats system, except in the instance of a security flaw in the GoSquared servers. Failure to inform visitors by lack of a privacy policy or other such legal document does not exempt a Member Site from these terms. By using the LiveStats service, Member Sites agree to the inclusion of such terms, an example of which is included in Appendix A.

GoSquared takes no responsibility for the content of any Member Sites, and claims no affiliation with any Member Site upon which the LiveStats service is implemented.

Data Recorded

The LiveStats system uses JavaScript technologies on the visitor's browser in order to determine a set of parameters that are then transmitted to the GoSquared servers. A full list of these parameters may be found in Appendix B. LiveStats uses a cookie on the visitor's browser in order to uniquely identify the visitor and to store parameters to aid with tracking this information. LiveStats uses Internet Protocol ("IP") Addresses in order to provide an accurate geographic location for visitors, but this is never revealed directly to anyone using the LiveStats service. GoSquared will never track or reveal any data sufficient to personally identify any visitor on a Member Site.

Violation of these Terms of Use

Go Squared reserves the right to disclose any information about you (including your identity) if we determine that such disclosure is necessary in connection with any legal investigation or complaint regarding your use of the GoSquared web site, or to identify, contact or bring legal action against anybody who may be causing injury to or interference with Go Squared's rights or property, or that of any of its subsidiaries, or the rights or property of visitors to or users of any part of the GoSquared web site. Go Squared reserves the right at all times to disclose any information that we deem necessary to comply with any applicable law, regulation, legal process or governmental request.

You acknowledge and agree that Go Squared may preserve any transmittal, correspondence or communication by you with Go Squared through the GoSquared web site, email or any other service offered on the GoSquared web site or through Go Squared, and may disclose such data if required to do so by law or if we deem it necessary in order to either comply with legal process, to enforce these Terms of Use, or to protect the rights and/or property of Go Squared, its employees, any users of or visitors to the GoSquared web site, and the public.

You agree that at any point, Go Squared may at its sole discretion and without prior notice, terminate your access to the GoSquared web site and/or block any future access by any and all means possible if we determine that you have violated any of these Terms of Use or the Terms of Use specified for any other part of Go Squared's web site or services, or any other agreements which may be associated with your use of the GoSquared web site, or for any cause which includes but is not limited to any request by law enforcement or other government agencies or any other technical issues or problems.

Appendix A: Suggested Terms to be Included in a Member Site Privacy Policy

This website makes use of the LiveStats tracking and real-time analytics service ("LiveStats") provided by Go Squared Ltd. ("GoSquared"). This service may record parameters of visitors' browsing on this site including but not limited to those detailed below:

Browser software, operating system software, browser location, Internet Protocol ("IP") Address, browser default language, screen resolution and color depth, Adobe Flash and Java plugin versions, referrer, site page view and visit counts.

By using this website you agree to this information being tracked and recorded by the LiveStats service. You also agree that GoSquared may put a tracking cookie on your system in order to uniquely identify your system. If you do not agree to this data being recorded, do not use this website.

Appendix B: Information Tracked and Recorded by the LiveStats Service

Information tracked, recorded and displayed in direct format to users of the LiveStats service:

  • Browser language
  • Screen resolution
  • Screen colour depth
  • Adobe Flash plugin version
  • Whether the Java runtime is enabled
  • Site page view and visit count
  • Referrer
  • All visited page URLs and Titles
  • Any data supplied directly through the Event Tracking and Custom Naming API

Data recorded and processed before being viewed via the LiveStats service, and those parameters for which they are used (the following data are never revealed in raw unprocessed form):

  • IP Address. Used to determine geographic location
  • Browser User Agent string. Used to determine browser software type and version, and operating system version

Feedback and Information

Any feedback you provide at this site will be deemed to be non-confidential. Go Squared will be free to use such information on an unrestricted basis.
